Wills and Probate
A will is a document that will dispose of the testator's (the person making the will) assets to people or entities upon the testator's death. The will can direct specific property to specific people or can be written broadly to direct all the property to go to a group of people. If the testator does not draft a will or does not draft a valid will, the testator's property will be distributed through the law of intestate succession. This law is a distribution scheme determined by the Arkansas legislature and often differs from a testator's desires.
Wills and probate
The will ensures that the testator's desires will be enforced after his or her death. The testator may choose the guardian of his or her children or name the person to manage a trust set up by the will. The testator may specify who will administer his or her estate as well as define his or her burial procedures. The testator may draft the will in order to minimize his or her tax consequences and keep his or her money in the family. The services of an experienced attorney are needed to advise the testator of his or her options, and to ensure that the testator's desires are carried out in full.
Probate is the process by which the probate court determines who receives the property and assets of the testator. The executor of the will, or an interested party if there is no will, is then in charge of collecting and preserving the assets of the estate, paying the estate's debts and distributing the estate's assets.
This process may take between six months and several years depending on the complexity of the estate. The process may take even longer if any of the heirs or legatees (people named in the will) choose to contest the will.
